Court blocks Virginia delegate law!

Court blocks Virginia delegate law

This matter is before the Court following a bench trial on
the merits of the FIRST AMENDED VERIFIED CLASS ACTION COMPLAINT
FOR INJUNCTIVE AND DECLARATORY RELIEF (the "Amended Complaint")
(ECF No. 20) filed by Carroll Boston Correll, Jr. C'Correll").
For the reasons, and to the extent, set forth below, judgment
including declaratory and injunctive relief will be entered for
Correll.

Virginia delegates are no longer bound to specific candidates.  This ruling will make it easier for delegates from other states to unbind as well.
Roy Moore's "spiritual warfare" is driving past a junior high without stopping.

SCOTUS ruled in 81 that a State can't override party rules on the matter and as the party rules state delegates are unbound, this is just more reinforcement.

Things may get interesting. This may make others more bold in freeing delegates and them more bold in how they vote.

And just in time for the rules committee to make it official. Reported earlier they have enough votes on the rules committee to officially unbind them. They just need to put pen to paper.

Of course, that will require some bold moves as generally the status quo wins out.

Its a foolish unenforceable law.

You can no more jail a delegate for voting against the will of the voters than you can jail a congressman. Elected people are elected to represent, not rubber stamp.

The ruling doesn't address state party rules concerning how delegates may be bound, so it doesn't actually "unbind" anybody -- it just says that states cannot make laws that bind delegates.

Nevertheless, it clears up previous rulings, and thus removes an important obstacle for freeing the delegates.

The other threshold is to get enough votes on the rules committee to release a "minority report" on the matter of either abstaining or unbinding delegates (I don't know which is the favored approach at the moment).  I believe that once a minority report reaches the floor of the convention it can be voted upon by the convention as a whole.

Well, no... In Hillary's case I think they preferred state law to govern, as it makes it harder for Sanders delegates to lead a revolt.

It's interesting they chose the First Amendment tack. I would've gone with the jurisdiction approach: Virginia law can't dictate what people do in Ohio.
